On 7 May 2010, the Financial Market Authority (FMA) published on its website that it informed Wiener Börse AG that it had gained knowledge of facts justifying the revocation of the admisstion of the stocks of webfreeTV.com Multimedia Dienstleistungs Aktiengesellschaft to the Second Regulated Market. Wiener Börse AG has been instructed by FMA to conduct an investigation in this context.
In the execution of this order, Wiener Börse AG initiated procedures to investigate the grounds for a revocation of the admission of the stocks of webfreeTV.com Multimedia Dienstleistungs Aktiengesellschaft to the Second Regulated Market.
The FMA is of the opinion that (i) there is an information deficit in the market and webfreeTV.com Multimedia Dienstleistungs Aktiengesellschaft complies only insufficiently with its disclosure obligations (ad-hoc disclosure) (grounds for the rescission of admission to trading pursuant to Article 66 para 8 Austrian Stock Exchange Act: violation of the obligations pursuant to Articles 81 through 87 Stock Exchange Act) and (ii) the postponement of the implementation of the solution scenarios announced already several times (and if such scenarios should fail, the possible insolvency of the company) is a violation of the vital interests of the investing public and thus constitutes a reason for the rescission of admission to trading pursuant to Art. 64 para 4 Stock Exchange Act (last sentence).
