Trading rules concerning Short Selling

Due to the numerous enquiries we have again prepared information on the changes to the trading rules of the Wiener Börse AG:

Trading Rules for the Automated Trading System, XETRA® (Exchange Electronic Trading)

Article 18 Self-dealings (Cross Trades), Prohibition of Short Selling

(1) The entry of opposing trades by one single exchange member for the same security and which
could lead to the execution of an order in the electronic trading system (crossing trades) shall not be
permitted, if the exchange member acts knowingly on both the buy and the sell side for its own
account or for the account of one and the same customer. These types of trades shall not result in
exchange prices in continuous trading if the exchange member trades for its own account. Sentence 1
shall apply accordingly to any other behavior that effectively constitutes a conscious manoeuvre to
circumvent this rule.

(2) Transactions the result in a short position or in the increase of a short position (so-called short
selling) in shares shall not be permitted. Short positions result when a seller of a share is not the
owner of the concerned securities at the time of the transaction, or when at the time of the transaction
the seller does not have any unconditional right under contract law or property law to enforce the
transfer of ownership of securities of the same category or when the seller does not have any
unconditional right under contract law or property law that would result in the transfer of ownership of
securities of the same category. The transactions of exchange members that have assumed the
obligation to enter binding bid and ask prices (quotes) into the system (market makers, specialists and
liquidity providers in auction trading) shall be exempted from this prohibition if these transactions are
necessary in order for them to fulfill their contractual obligations. Short selling that serves to secure
already existing positions shall also be exempt from this prohibition.
